1. On 04/01/2019, in response to a request by the Coalition of American Flange Producers (petitioners), Commerce issued a final scope determination that EN Corporation's stainless steel flanges forged in the People's Republic of China (China) or India and finished in the Philippines are within the scope of the antidumping and countervailing duty orders on stainless steel flanges from China and India (A-570-064; C-570-065; A-533-877; C-533-878).

2. This message pertains specifically to the countervailing duty orders from China and India. Because the scope language of the orders (see message 8162301, dated 6/11/2018, and message 8284302, dated 10/11/2018), explicitly state that “the country of origin for certain forged stainless steel flanges, whether unfinished, semi-finished, or finished is the country where the flange was forged”, Commerce found EN Corporation's exports of stainless steel flanges forged in China or India and finished in the Philippines, to be within the scope of the order.

3. Accordingly, CBP should suspend, or continue to suspend (as appropriate), liquidation of entries of the merchandise described in paragraph 2, subject to the countervailing duty order on stainless steel flanges from China and India. The case numbers below have been created to accommodate entries of EN Corporation's stainless steel flanges forged in China or India, finished in the Philippines and subsequently exported to the United States, and which are subject to the countervailing duty orders on stainless steel flanges from China and India.
