1. On 08/03/2018, the U.S. Court of International Trade (CIT) sustained the Final Redetermination issued by the Department of Commerce (Commerce) pursuant to Atkore Steel Components, Inc. v. United States (CIT No. 17-00077). As a result, Commerce published in the Federal Register (83 FR 44262) on 08/30/2018, with an effective date of 08/13/2018, the Notice of Court Decision Not in Harmony with Final Scope Ruling and Notice of Amended Final Scope Ruling Pursuant to Court Decision.

2. Although, as a result of the CIT's final decision, certain cast iron electrical conduit articles imported by Atkore Steel Components, Inc. (Atkore), described below in paragraph 3, are outside of the antidumping duty order on certain malleable cast iron pipe fittings from the People's Republic of China (China), Customs and Border Protection (CBP) is directed to suspend or continue to suspend liquidation of the entries of malleable cast iron pipe fittings from China imported by Atkore, described below in paragraph 3 entered, or withdrawn from warehouse, for consumption on or after 08/13/2018.

3. As a result of the CIT's final decision, a cash deposit rate of zero is applicable to the following entries of certain electrical conduit fittings imported by Atkore entered, or withdrawn from warehouse, for consumption on or after 08/13/2018:

(1) Electrical conduit bodies range in size from 4 inches to ½ inch in diameter, meeting Underwriters Laboratories (UL) safety standards 514A, and including electrical box-fill information.
(2) Cast iron electrical conduit nipples (i.e., pieces which extend a run of conduit or connect/attach similar conduit articles) meeting UL 514B Safety Standards (generally stamped with a UL Mark).
(3) Cast iron electrical conduit couples and connectors (i.e., pieces of electrical conduit that join two other pieces of electrical conduit together) meeting UL 514B Safety Standards (generally stamped with a UL Mark).

4. Because the revised cash deposit rate is to be applied retroactively to entries made on or after 08/13/2018, Commerce will issue instructions for granting a refund on any over collection in a separate message.

5. These cash deposit requirements will remain in effect until further notice.

6. Do not liquidate any entries of the merchandise covered by paragraph 3 above until specific liquidation instructions are issued.

7. Unless instructed otherwise, for all other shipments of certain malleable cast iron pipe fittings from China not covered by paragraphs 2 and 3 above, you shall continue to collect cash deposits of estimated antidumping duties for the merchandise at the current rates.
