1. On 05/30/2018, Commerce published in the Federal Register (83 FR 24745) its final affirmative determination of sales at less-than-fair-value in the antidumping duty investigation of fine denier polyester staple fiber (fine denier PSF) from Taiwan (A-583-860).

2. The merchandise covered by this investigation is fine denier polyester staple fiber (fine denier PSF), not carded or combed, measuring less than 3.3 decitex (3 denier) in diameter. The scope covers all fine denier PSF, whether coated or uncoated. The following products are excluded from the scope:

(1) PSF equal to or greater than 3.3 decitex (more than 3 denier, inclusive) currently classifiable under Harmonized Tariff Schedule of the United States (HTSUS) subheadings 5503.20.0045 and
5503.20.0065.

(2) Low-melt PSF defined as a bi-component polyester fiber having a polyester fiber component that melts at a lower temperature than the other polyester fiber component, which is currently classifiable under HTSUS subheading 5503.20.0015.

Fine denier PSF is classifiable under the HTSUS subheading 5503.20.0025. Although the HTSUS subheadings are provided for convenience and customs purposes, the written description of the scope of this investigation is dispositive.

3. This proceeding has been assigned case number A-583-860.

4. For imports of fine denier PSF from Taiwan, CBP shall continue to suspend liquidation of such shipments entered, or withdrawn from warehouse, for consumption on or after 01/05/2018 (date suspension first started). Effective 05/30/2018, CBP shall require, for such entries, a cash deposit equal to the margins for the producers and/or exporters listed below:

Cash deposit rate: 48.86%

All Others

Cash Deposit Rate: 24.43%

5. Commerce found that no final margin exists with respect to merchandise produced and exported by Tainan Spinning Co., Ltd. Accordingly, CBP shall not suspend liquidation of such shipments entered, or withdrawn from warehouse, for consumption on or after 01/05/2018. Entries of subject merchandise from Tainan Spinning Co., Ltd., in any other producer/exporter combination, or by third parties that sourced subject merchandise from the excluded producer/exporter combination, are subject to the all others rate.

6. If any entries of this merchandise are exported by a firm other than the producer, then the following instructions apply:

A. If the exporter of the subject merchandise does not have its own rate but the producer has its own rate, the cash deposit rate will be the producer's rate.

B. Where neither the exporter nor the producer currently has its own rate or the producer is unknown, use the all-others rate of 24.43 percent to establish the cash deposit rate.
