Commerce received a scope ruling request from Greenbrier International, Inc. (Greenbrier).
Commerce issued a final scope determination on 10/30/2017 that Greenbrier's neon and white poster board which Greenbrier imports are not within the scope of the countervailing duty order on certain coated paper suitable for high-quality print graphics using sheet-fed presses (Coated Paper) from the People's Republic of China (PRC) (C-570-959).

Commerce determined that Greenbrier's neon and white poster board products are outside the scope of the order because the products do not meet certain requirements specified in the description of the scope of the order.
Greenbrier's neon poster board is coated in organic material, and it is not intended for or suitable for the commercial print industry because it is imported in packages containing five pieces of neon poster board, in cartons of 24 retail packages.
Greenbrier's white poster board is not intended for or suitable for the commercial print industry because it is imported in packages containing five pieces of white poster board in cartons of 24 retail packages.
As a result, Greenbrier's neon poster board does not meet the requirement in the scope that the merchandise be coated with inorganic material, and that it be suitable for high quality print graphics using sheet-fed presses, namely for the commercial print market, and Greenbrier's white poster board does not meet the requirement in the scope that the merchandise be suitable for high quality print graphics using sheet-fed presses, namely for the commercial print market.
Therefore, Greenbrier's neon and white poster board are not within the scope of the countervailing duty order on Coated Paper from the PRC.

For all entries of Greenbrier's neon poster board imported under stock keeping unit (SKU) number 220079 and white poster board imported under SKU number 206968 that remain unliquidated on or after 11/17/2010, CBP shall terminate suspension and liquidate entries of product not within scope which were entered, or withdrawn from warehouse, for consumption.

Refund any cash deposits and release any bonds relating to Greenbrier's neon and white poster board not within the scope as described above.

These instructions constitute notice of the lifting of suspension of liquidation of entries of Greenbrier's neon and white poster board coated described above not within scope entered, or withdrawn from warehouse, for consumption on or after 11/17/2010.

The assessment of countervailing duties by CBP on shipments or entries of this merchandise is subject to the provisions of section 778 of the Tariff Act of 1930, as amended.
Section 778 requires that CBP pay interest on overpayments or assess interest on underpayments of the required amounts deposited as estimated countervailing duties.
The interest provisions are not applicable to cash or bonds posted as estimated countervailing duties before the date of publication of the countervailing duty order.
Interest shall be calculated from the date payment of estimated countervailing duties is required through the date of liquidation.
The rate at which such interest is payable is the rate in effect under section 6621 of the Internal Revenue Code of 1954 for such period.

Unless instructed otherwise, for all other shipments of Greenbrier's neon and white poster board from the PRC not covered by paragraph 2 above, you shall continue to collect cash deposits of estimated countervailing duties for the merchandise at the current rates.
