1. On 12/21/2016, the U.S. Court of International Trade issued a preliminary injunction (PI) enjoining liquidation of entries identified in paragraph 2 which are subject to the antidumping duty order on certain pasta from Turkey (A-489-805) for the period 07/01/2014 through 06/30/2015. This PI was issued in connection with court number 16-00266.

2. This PI enjoins liquidation of entries which were entered, or withdrawn from warehouse, for consumption on or after July 1, 2014, through June 30, 2015; were the subject of the administrative proceeding published as Certain Pasta from Turkey: Final Rescission of Antidumping Duty New Shipper Review; 2014-2015, 81 Fed. Reg. 86,701 (Dep't of Commerce Dec. 1, 2016) (“Final Rescission”); and were produced and exported from Turkey to the United States by Durum Gida Sanyi ve Ticaret, A.S.; and remain unliquidated as of 5 p.m. on December 21, 2016.

3. Effective 12/21/2016 (the date the Court issued the PI), no liquidation may be made for entries referred to in paragraph 2 which remain unliquidated as of 5 p.m. on 12/21/2016. Any such entries that are set for liquidation must be unset immediately. Continue to suspend liquidation of these entries until liquidation instructions are issued.

4. Effective immediately, CBP is instructed to follow the terms of the PI.

5. The PI applies to the liquidation instructions in message number 6351303, dated 12/16/2016.
