1. On 08/17/2016, in response to a request by Curations Limited (“Curations”), Commerce issued a final scope determination that fourteen case goods which Curations imports from the People's Republic of China (“PRC”) are within the scope of the antidumping duty order on wooden bedroom furniture from the PRC (A-570-890). The fourteen case goods are the: (1) Baxley 4-Drawer 38W (8850.1120); (2) Baxley Double Drawers (8850.1123); (3) Baxley Chest (8850.1124); (4) Baxley Chest (8850.1125); (5) Alden Double Drawers (8850.1127); (6) Alden Drawers (8850.1128); (7) Alden Side Chest (8850.1129); (8) Alden 3-Drawer 40W (8850.1133); (9) Baxley Stand Closed 24W (8850.1121); (10) Alden Stand 3-Drawer (8850.1132); (11) Baxley Stand Open 24W (8850.1122); (12) Alden Stand Open (8850.1131); (13) Alden Side Table (8850.1130); and (14) Baxley Side Table (8850.1126).

Because eight of these fourteen imported case goods (i.e. (1) Baxley 4-Drawer 38W (8850.1120); (2) Baxley Double Drawers (8850.1123); (3) Baxley Chest (8850.1124); (4) Baxley Chest (8850.1125); (5) Alden Double Drawers (8850.1127); (6) Alden Drawers (8850.1128); (7) Alden Side Chest (8850.1129); (8) Alden 3-Drawer 40W (8850.1133)) have adequate space for storing clothing, lack decorative features to distinguish them from bedroom furniture, have been held out as suitable for the bedroom and described using terms consistent with bedroom furniture, include models which were marketed in connection with a picture showing items in the Baxley collection in a bedroom, and thus are not sufficiently distinguishable from chests, chests of drawers, or other wooden bedroom furniture explicitly covered by the scope of the antidumping duty order on wooden bedroom furniture from the PRC, Commerce found these products to be within the scope of the order.

Further, because six of the fourteen imported case goods (i.e. (1) Baxley Stand Closed 24W (8850.1121); (2) Alden Stand 3-Drawer (8850.1132); (3) Baxley Stand Open 24W (8850.1122); (4) Alden Stand Open (8850.1131); (5) Alden Side Table (8850.1130); and (6) Baxley Side Table (8850.1126)) have heights consistent with other nightstands subject to the order, are wider than they are deep, have been held out as “nightstands,” “bedside tables,” or “bedside chests” by Curations, and include a model which was marketed by Curations in a bedroom setting, Commerce found these products to be within the scope of the order.

3. Continue to suspend liquidation of entries of wooden bedroom furniture from the PRC, including the fourteen case goods imported by Curations described above which are subject to the antidumping duty order on wooden bedroom furniture from the PRC.
