1. This is a correction to message 7011216, dated 01/11/2007, to correct paragraph 3 of that message.

2. Paragraph 3 incorrectly identified the producer/exporter 10-digit case numbers for certain exporter/producer combinations. Below is the fully corrected message.

3. The Department of Commerce (Commerce) has completed its administrative review of the countervailing duty order (C-507-601) on certain in-shell roasted pistachios from Iran for the period 01/01/2004 through 12/31/2004 and published the final results in the Federal Register on 11/13/2006 (71 FR 66165).

4. Imports covered by the review are all roasted in-shell Pistachio nuts, whether roasted in Iran or elsewhere, from which the hull has been removed, leaving the inner hard shells and the edible meat, as currently classifiable in the HTSUS under item Number 0802.50.20.00. Although the HTSUS subheading is provided for convenience and customs purposes, the written description of the merchandise is dispositive.

5. Accordingly, for shipments of certain in-shell roasted Pistachios from Iran, from the following producer/exporter combinations, entered, or withdrawn from warehouse, for consumption on or after November 13, 2006, you shall collect a cash deposit of estimated countervailing duties at the following percentages of the entered value price:

Producer: Maghsoudi Farms
Exporter: Tehran Negah Nima Trading Company, Inc. (Nima)
Case number: C-507-601-001
Rate: 66.50 % ad valorem

Producer: Any manufacturer other than Maghsoudi Farms or Razi Domghan Agricultural and Animal Husbandry Company

Rate: 66.50 % ad valorem

Producer: Razi Domghan Agricultural and Animal Husbandry Company

Note to CBP: As a result of this review, Commerce determined to apply producer/exporter chain rates to merchandise exported by Tehran Negah Nima Trading Company, Inc. (NIMA). Accordingly, Commerce has deactivated the following exporter case number previously applicable to this exporter: C-507-601-502.

6. For all manufacturers/exporters of certain in-shell roasted Pistachios from Iran without their own rate, the cash deposit rate is 317.89 percent ad valorem.

7. This requirement for a cash deposit will remain in effect until publication of the final results of the next administrative review. Do not liquidate any entries of merchandise included in this administrative review until assessment instructions are received.
