1. On 06/23/2016, in response to a request by Silevo, Inc., a wholly-owned subsidiary of SolarCity Corporation (collectively, SolarCity), Commerce issued a final scope determination that the Triex photovoltaic cells which SolarCity imports are within the scope of the countervailing duty order on crystalline silicon photovoltaic cells, whether or not assembled into modules (solar cells), from the People's Republic of China (the PRC) (C-570-980).

2. Because the imported product is similar to the subject solar cells in terms of physical characteristics, ultimate purchaser expectations, ultimate use, channels of trade, and manner of advertisement and display, Commerce found this product to be within the scope of the order.

3. Continue to suspend liquidation of entries of solar cells from the PRC, including the Triex photovoltaic cells imported by SolarCity described above, subject to the countervailing duty order on solar cells from the PRC.
