1. On 2/17/2026, the International Trade Commission published in the Federal Register (91 FR 7302, 2/17/2026) its final determination notifying Commerce that imports of hard empty capsules from Brazil threaten the U.S. industry with material injury. 2. In accordance with section 706(b)(2) of the Tariff Act of 1930, as amended, CBP should terminate the suspension of liquidation for all shipments of hard empty capsules from Brazil that were entered, or withdrawn from warehouse, for consumption before 2/17/2026. All entries of subject merchandise that were entered, or withdrawn from warehouse, for consumption before 2/17/2026 should be liquidated without regard to countervailing duties (i.e., return all cash deposits). 3. Notice of the lifting of suspension of liquidation of entries of merchandise entered, or withdrawn from warehouse, for consumption before 2/17/2026 occurred with the publication of the ITC's final determination of its investigation (91 FR 7302, 2/17/2026). For all other shipments of hard empty capsules from Brazil, continue to collect cash deposits of estimated countervailing duties for the merchandise at the current rates unless instructed otherwise. 4. The interest provisions of section 778 of the Tariff Act of 1930, as amended, do not apply. 5.
