Re: Revocation of antidumping duty order, in part, on Crystalline Silicon Photovoltaic Products, Whether or Not Assembled into Modules, from the People's Republic of China (A-570-010)
1. As a result of a changed circumstances determination with respect to certain small, low-wattage, off-grid cells that are subject to the antidumping duty order on crystalline silicon photovoltaic products from the People's Republic of China, Commerce has revoked the antidumping duty order, in part, with respect to certain small, low-wattage, off-grid (CSPV) cells, in rigid form, with or without a glass cover, permanently attached to an aluminum extrusion that is an integral component of an automation device that controls natural light, whether or not assembled into a fully completed automation device that controls natural light, with the following characteristics: (1) A total power output of 20 watts or less per panel; (2) A maximum surface area of 1,000 cm2 per panel; and (3) Does not include a built-in inverter for powering third party devices. Commerce published the revocation in the Federal Register on 07/24/2025 (90 FR 34838).
2. Therefore, CBP is directed to terminate the suspension of liquidation for all shipments of CSPV panels with the characteristics described at paragraph 1 of this message entered, or withdrawn from warehouse, for consumption on or after 12/01/2022. All unliquidated entries of the revoked product that were suspended on or after 12/01/2022 should be liquidated without regard to antidumping duties (i.e., refund all cash deposits).
3. Notice of the lifting of suspension of liquidation of entries of subject merchandise which are covered by paragraph 2 and entered, or withdrawn from warehouse, for consumption on or after 12/01/2022 occurred with the publication of the notice of revocation in the Federal Register (90 FR 34838, 07/24/2025).
4. The assessment of antidumping duties by CBP on shipments or entries of this merchandise is subject to the provisions of section 778 of the Tariff Act of 1930, as amended. Section 778 requires that CBP pay interest on overpayments or assess interest on underpayments of the required amounts deposited as estimated countervailing duties. The interest provisions are not applicable to cash posted as estimated antidumping duties before the date of publication of the antidumping duty order. Interest shall be calculated from the date payment of estimated antidumping duties is required through the date of liquidation. The rate at which such interest is payable is the rate in effect under section 6621 of the Internal Revenue Code of 1954 for such period.
