On 04/25/2025, Commerce published in the Federal Register (90 FR 17388) its final determination of sales at less than fair value in the antidumping duty investigation of crystalline silicon photovoltaic cells, whether or not assembled into modules (solar cells), from the Socialist Republic of Vietnam (Vietnam).

Commerce determined that critical circumstances do not exist for imports of solar cells from the producer/exporter combinations listed below.
Accordingly, for imports of solar cells from Vietnam, CBP shall continue to suspend liquidation of such shipments entered, or withdrawn from warehouse, for consumption on or after 12/04/2024.
Effective 04/25/2025, CBP shall require, for entries of solar cells from Vietnam from the producer and exporter combinations listed below, a cash deposit equal to the antidumping duty cash deposits shown below:

Because Commerce has determined that critical circumstances do not exist for imports of solar cells from Vietnam from the producer/exporter combinations listed below, the retroactive suspension of liquidation ordered in message 4347403, dated 12/12/2024, is terminated.
Accordingly, Commerce will direct CBP in separate instructions to terminate the suspension of liquidation for all shipments of solar cells from Vietnam from the companies listed below entered, or withdrawn from warehouse, for consumption, before 12/04/2024.
The interest provisions of section 778 of the Tariff Act of 1930, as amended, do not apply.
Accordingly, for imports of solar cells from Vietnam, CBP shall continue to suspend liquidation of such shipments entered, or withdrawn from warehouse, for consumption on or after 12/04/2024.

Because Commerce determined that critical circumstance exist, in part, for imports of solar cells from Vietnam for the Vietnam-Wide Entity, CBP shall suspend liquidation of all appropriate entries of solar cells from Vietnam that are entered, or withdrawn from warehouse, for consumption on or after 09/05/2024, which is 90 days before the date of publication of the preliminary determination in the Federal Register.
Effective 04/25/2025, CBP shall require, for entries of solar cells from Vietnam from the Vietnam-Wide Entity, a cash deposit equal to the antidumping duty cash deposit shown below:

For all other entries of solar cells from Vietnam, the following cash deposit instructions apply:
A.
For all Vietnamese exporters of solar cells from Vietnam which have not received their own rate, the cash deposit will be the Vietnam-wide rate.
B.
For all non-Vietnamese exporters of solar cells from Vietnam which have not received their own rate, the cash deposit rate will be the rate applicable to the exporter/producer combinations that supplied that non-Vietnamese exporter.
