1. On 03/25/2025, the U.S. Court of International Trade issued a temporary statutory injunction (SI) enjoining liquidation of entries identified in paragraph 2 which are subject to the countervailing duty order on frozen warmwater shrimp from Ecuador (/C-331-806) for the period
04/01/2024 through 07/29/2024 and 12/17/2024 through 12/31/2024. This SI was issued in connection with court number 25-00026.
2. This SI enjoins liquidation of entries which Frozen Warmwater Shrimp form Ecuador that were: produced and/or exported by Industrial Pesquera Santa Priscila S.A. (including the following cross-owned companies: Manesil S.A., Produmar S.A., Egidiosa, S.A., and Tropical Packing Ecuador S.A.); Sociedad Nacional de Galapagos
(including the following crossed-owned companies: Naturisa S.A., Holding Sola & Sola Solacciones S.A., and Empacadora Champmar S.A.), and all other producers/exporters that were covered by the final determination in Frozen Warmwater Shrimp from Ecuador: Final Affirmative Countervailing Duty Determination, 89 Fed. Reg. 85,506 (Dep't Commerce Oct. 28, 2024) that were entered, or withdrawn from warehouse, for consumption, during the period
04/01/2024 through 07/29/2024 and 12/17/2024 through 12/31/2024.
3. Effective 03/25/2025, no liquidation may be made for entries referred to in paragraph 2 which remain unliquidated as of (insert time period specified by court, e.g., 03/25/2025. Any such entries that are set for liquidation must be unset immediately. Continue to suspend liquidation of these entries until liquidation instructions are issued.
4. Effective immediately, CBP is instructed to follow the terms of the TRO/SI.
5. Liquidation instructions for entries affected by this SI have not yet been issued.
