1. On 01/10/2024, Commerce issued a final scope ruling that finished chassis containing Chinese-origin axle and landing gear components imported by Pitts Enterprises, Inc. dba Dorsey Intermodal from the Socialist Republic of Vietnam (Vietnam) are covered by the scope of the antidumping and countervailing duty orders on certain chassis and subassemblies from the People's Republic of China (A-570-135, C-570-136). 2. Specifically, Commerce determined that finished chassis containing Chinese-origin axle and landing gear components imported by Pitts Enterprises, Inc. dba Dorsey Intermodal from Vietnam are covered by the scope of the order(s) because the imported product contains Chinese-origin subassemblies. 3. This final scope ruling is applicable only to merchandise imported by Pitts Enterprises, Inc. dba Dorsey Intermodal. 4a. Continue to suspend liquidation of entries of finished chassis containing Chinese-origin axle and landing gear components imported by Pitts Enterprises, Inc. dba Dorsey Intermodal from Vietnam that are already subject to the suspension of liquidation under the antidumping and countervailing duty orders on certain chassis and subassemblies from China at the cash deposit rate(s) in effect on the date of entry in accordance with message 3081408, dated 03/22/2023 and message 3292404, dated 10/19/2023. 4b. For all entries of finished chassis containing Chinese-origin axle and landing gear components imported by Pitts Enterprises, Inc. dba Dorsey Intermodal from Vietnam that are not already subject to the suspension of liquidation, CBP should suspend liquidation of: (i) shipments entered, or withdrawn from warehouse, for consumption on or after 03/15/2023 (date of initiation of the scope inquiry), and (ii) shipments entered, or withdrawn from warehouse, for consumption prior to the date of initiation of the scope inquiry but no earlier than 11/04/2021(effective date of the suspension rules in the new scope regulations). CBP shall require, for such entries, a cash deposit at the applicable rate(s) in effect on the date of entry. 4c. Commerce established third-country case numbers to allow finished chassis containing Chinese-origin axle and landing gear components imported by Pitts Enterprises, Inc. dba Dorsey Intermodal from Vietnam to be properly reported as subject to the order on certain chassis and subassemblies from China (A-570-135; C-570-136) upon entry.
