RE: TERMINATION OF SUSPENSION OF LIQUIDATION: COUNTERVAILING
DUTY INVESTIGATION OF SULFANILIC ACID FROM INDIA


1. IN KEEPING WITH ARTICLE 5, PARAGRAPH 3 OF THE AGREEMENT ON
INTERPRETATION AND APPLICATION OF ARTICLES VI,XVI, AND XXIII OF
THE GENERAL AGREEMENT ON TARIFFS AND TRADE (THE SUBSIDIES CODE),
THE DEPARTMENT IS TERMINATING THE SUSPENSION OF LIQUIDATION ON
SULFANILIC ACID FROM INDIA ON DECEMBER 9, 1992, WHICH IS 120 DAYS
AFTER THE DATE OF PUBLICATION OF THE PRELIMINARY DETERMINATION.

2. THE PRODUCTS COVERED BY THIS INVESTIGATION ARE ALL GRADES OF
SULFANILIC ACID, WHICH INCLUDE TECHNICAL (OR CRUDE) SULFANILIC
ACID, REFINED (OR PURIFIED) SULFANILIC ADIC, AND REFINED SODIUM
SALT OF SULFANILIC ACID (SODIUM SULFANILATE). SULFANILIC ACID IS
A SYNTHETIC ORGANIC CHEMICAL PRODUCED FROM THE DIRECT SULFONATION
OF ANILINE WITH SULFURIC ACID. SULFANILIC ACID IS USED AS A RAW
MATERIAL IN THE PRODUCTION OF OPTICAL BRIGHTENERS, FOOD COLORS,
SPECIALITY DYES, AND CONCRETE ADDITIVES. THE PRINCIPAL
DIFFERENCES BETWEEN THE GRADES RELATES TO THE AMOUNT OF
UNDESIRABLE QUANTITIES OF RESIDUAL ANILINE AND ALKALI INSOLUBLE
MATERIALS PRESENT IN THE SULFANILIC ACID. ALL GRADES ARE
AVAILABLE AS DRY, FREE FLOWING POWDERS.

TECHINCAL SULFANILIC ACID, CLASSIFIED UNDER THE SUBHEADING
2921.42.24.20 OF THE HARMONIZED TARIFF SCHEDULE (HTS) CONTAINS 96
PERCENT MINIMUM SULFANILIC ACID, 1.0 PERCENT MAXIMUM ANILINE AND
1.0 PERCENT MAXIMUM ALKALI INSOLUBLE MATERIALS, REFINED
SULFANILIC ACID, CLASSIFIED UNDER THE HTS SUBHEADING
2921.42.24.20, CONTAINS 98 PERCENT MINIMUM SULFANILIC ACID, 0.5
PERCENT MAXIMUM ANILINE AND 0.25 PERCENT MAXIMUM ALKALI INSOLUBLE
MATERIALS. REFINED SODIUM SALT OF SULFANILIC ACID (SODIUM
SULFANILATE), CLASSIFIED UNDER THE HTS SUBHEADING 2921.42.70 IS A
GRANULAR OR CRYSTALLINE MATERIAL CONTAINING 75 PERCENT MINIMUM
EQUIVALENT SULFANILIC ACID, 0.5 PERCENT MAXIMUM ANILINE, AND 0.25
PERCENT MAXIMUM ALKALI INSOLUBLE MATERIALS BASED ON THE
EQUIVALENT SULFANILIC ACID CONTENT.

ALTHOUGH THE HTS SUBHEADING ARE PROVIDED FOR CONVENIENCE AND
CUSTOMS PRUPOSES, OUR WRITTEN DESCRIPTION OF THE SCOPE OF THIS
INVESTIGATION IS DISPOSITIVE.

3. FIELD OFFICERS SHALL TERMINATE THE SUSPENSION OF LIQUIDATION
FOR COUNTERVAILING DUTY PURPOSES ON ALL ENTRIES OF THE SUBJECT
MERCHANDISE MADE ON OR AFTER DECEMBER 9, 1992. THE SUSPENSION OF
LIQUIDATION WILL NOT BE RESUMED UNLESS AND UNTIL THE DEPARTMENT
PUBLISHES A COUNTERVAILING DUTY ORDER IN THIS CASE. FIELD
OFFICES SHALL CONTINUE TO SUSPEND LIQUIDATION ON ALL ENTRIES OF
CONSUMPTION MADE DURING THE PERIOD AUGUST 11, 1992, THROUGH
DECEMBER 8, 1992, UNTIL THE CONCLUSION OF THE COUNTERVAILING DUTY
INVESTIGATION.

4. THE TERMINATION DOES NOT AFFECT THE REQUIREMENT OF A CASH
DEPOSIT OR BOND ON ENTRIES SUBJECT TO SUSPENSION OF LIQUIDATION
ORDERED ON OCTOBER 22, 1993, IN THE COMPANION ANTIDUMPING DUTY
INVESTIGATION OF SULFANILIC ACID FROM INDIA.

5. FOR FURTHER REPORTING PURPOSES, THIS CASE HAS BEEN ASSIGNED
INVESTIGATION NUMBER C-533-807.
