RE: SUPPLEMENTAL INSTRUCTIONS EXPLAINING ENTRY REQUIREMENTS
FOR RE-EXPORT SHIPMENTS FROM COUNTRIES SUBJECT TO THE
SUSPENSION AGREEMENTS ON URANIUM- JFK RELEASE INFORMATION

1. RE-EXPORTS ARE SHIPMENTS OF URANIUM FROM RUSSIA, KAZAKHSTAN,
KYRGYZSTAN, OR UZBEKISTAN THAT ARE BEING TEMPORARILY IMPORTED
INTO THE UNITED STATES FOR FURTHER PROCESSING AND THEN
RE-EXPORTED. THIS IS PERMITTED PURSUANT TO SECTION IV.H OF THE
URANIUM SUSPENSION AGREEMENTS SIGNED WITH EACH OF THESE
COUNTRIES.

2. IN ADDITION TO ANY DOCUMENTS CUSTOMS NEEDS, COMMERCE REQUIRES
BOTH OF THE FOLLOWING DOCUMENTS FOR ANY RE-EXPORTS: 1) A
RE-EXPORT CERTIFICATE FROM THE GOVERNMENT OF THE EXPORTING
COUNTRY FOR EACH SHIPMENT, INCLUDING QUANTITY OF SHIPMENT AND
DATE SHIPPED; AND 2) A CERTIFICATION FROM THE IMPORTER OF RECORD
CERTIFYING THAT THE MATERIAL IN QUESTION WILL BE RE-EXPORTED
WITHIN 12 MONTHS, PURSUANT TO SECTION IV.H OF THE RELEVANT
SUSPENSION AGREEMENT. AFTER THE ABOVE IS RECEIVED BY CUSTOMS,
THE SHIPMENT IS OK TO RELEASE.

3. COMMERCE IS AWARE THAT TWELVE SAMPLES OF RUSSIAN URANIUM HAVE
ARRIVED AT THE PORT OF NEW YORK-JFK AIRPORT. WE UNDERSTAND THAT
ALL DOCUMENTS HAVE BEEN RECEIVED TO CUSTOMS' SATIFACTION
REGARDING THESE SAMPLES, AND THAT THEY CAN NOW BE RELEASED.
