1. On 03/16/2023, Commerce issued a preliminary scope ruling that merchandise that is exported from Malaysia, and that consists of finished wooden doors, drawer faces, and frames produced in China that are combined with wooden cabinet boxes and drawer boxes produced in Malaysia is covered by the scope of the antidumping and countervailing duty orders on wooden cabinets and vanities and components thereof from People's Republic of China (A-570-106 and C-570-107). 2. Specifically, Commerce preliminarily determined that merchandise that is exported from Malaysia, and that consists of finished wooden doors, drawer faces, and frames produced in China that are combined with wooden cabinet boxes and drawer boxes produced in Malaysia is covered by the scope of the orders because it is not substantially transformed in Malaysia. 3. This preliminary scope ruling is applicable on a country-wide basis, regardless of foreign producer, exporter, or importer. 4. Continue to suspend liquidation of entries of merchandise that is exported from Malaysia, and that consists of finished wooden doors, drawer faces, and frames produced in China that are combined with wooden cabinet boxes and drawer boxes produced in Malaysia that are already subject to the suspension of liquidation in accordance with messages 2153401, dated 06/02/2022. 5. For all entries of merchandise that is exported from Malaysia, and that consists of finished wooden doors, drawer faces, and frames produced in China that are combined with wooden cabinet boxes and drawer boxes started and finished in Malaysia covered by this ruling not already subject to the suspension of liquidation, CBP should suspend liquidation of: (i) shipments entered, or withdrawn from warehouse, for consumption on or after 05/24/2022, and (ii) shipments entered, or withdrawn from warehouse, for consumption prior to the date of initiation of the scope inquiry but no earlier than 11/04/2021. CBP shall require, for such entries, a cash deposit at the applicable rate(s) in effect on the date of entry. 6. Entries of products covered by paragraphs 4 and 5 should not be liquidated until specific liquidation instructions are issued. Any such entries that are set for liquidation must be unset immediately. 7. Effective 11/04/2021, Commerce established third-country case numbers to allow merchandise that is exported from Malaysia, and that consists of finished wooden doors, drawer faces, and frames produced in China that are combined with wooden cabinet boxes and drawer boxes produced in Malaysia to be properly reported as subject to the order on wooden cabinets and vanities and components thereof from People's Republic of China (A-570-106 and C-570-107) upon entry.
