1. On 06/22/2023, Commerce issued a final scope ruling that certain quartz shower trays and quartz integrated vanity tops are covered by the scope of the antidumping/countervailing duty orders on certain quartz surface products from India (A-533-889, C-533-890). 2. Specifically, Commerce determined that the following quartz shower tray models produced and exported by Pokarna Engineering Stone Ltd. (PESL) are covered by the scope of the orders: Capri, Sardinia, Tenerife, Hvar, Corsica, Elba, Sicily, Milos, Burano, Valeta, Ischia, Hoy, Crete, Cyprus, Menorca, Gozo, and Mallorca. Commerce also determined that the following quartz integrated vanity top models produced and exported by (PESL are covered by the scope of the orders: Ballino, Braccio, Lilaz, Liri, Mezzo, Molina, Monticelli, Riva, Sasso, Sellero, Serio, Stivo, Stroppia, Tenno, Treja, Valagnna, Varone, and Vertova. Commerce determined that the quartz shower tray models produced and exported by PESL are covered by the scope based on the plain language of the scope. Commerce determined that the quartz integrated vanity top models produced and exported by PESL are covered by the scope of the orders based on an application of the factors set forth in 19 CFR 351.225(k)(2) because the quartz integrated vanity tops have similar physical characteristics, expectations of the ultimate purchaser, ultimate use, and channels of trade to in-scope quartz surface products. 3. This final scope ruling is applicable only to merchandise produced and exported by PESL. 4a. Continue to suspend liquidation of entries of PESL's quartz shower tray models and quartz integrated vanity top models listed in paragraph 2 that are already subject to the suspension of liquidation under the antidumping and countervailing duty orders on certain quartz surface products from India at the cash deposit rates in effect on the date of entry in accordance with message 2280401, dated 10/07/2022. 4b. For all entries of PESL's quartz shower tray models and quartz integrated vanity top models listed in paragraph 2 not already subject to the suspension of liquidation, CBP should suspend liquidation of: (i) shipments entered, or withdrawn from warehouse, for consumption on or after 09/27/2022, and (ii) shipments entered, or withdrawn from warehouse, for consumption prior to the date of initiation of the scope inquiry but no earlier than November 4, 2021. CBP shall require, for such entries, a cash deposit at the applicable rate(s) in effect on the date of entry. 5. Entries of products covered by paragraph 4 should not be liquidated until specific liquidation instructions are issued. 6. In accordance with 19 CFR 351.225(l)(5), this instruction does not affect or otherwise limit CBP's independent authority to take any additional action with respect to the suspension of liquidation or related measures. 7.
