1. On 06/23/2023, Commerce issued a preliminary covered merchandise determination that unfinished butt-weld pipe fittings that undergo finishing processes in Vietnam are covered by the scope of the antidumping duty order on certain carbon steel butt-weld pipe fittings (butt-weld pipe fittings) from the People's Republic of China (A-570-814). See 88 FR 41075. 2. According to the covered merchandise referral, the production of butt-weld pipe fittings involves three stages: 1) converting seamless pipe into the rough shape of an elbow, tee, reducer, etc., through cold- or hot-forming (or forging) process; 2) reforming or sizing the rough fittings so that the fitting will match the pipe it is destined to be welded to; and 3) undergoing finishing processes such as shot blasting or other cleaning, machine beveling, boring and tapering, grinding, die stamping, inspection, and painting (i.e. finishing processes). Unfinished fittings are considered to be fittings that have undergone production stages one and two. Commerce preliminarily determined that unfinished butt-weld pipe fittings from China that undergo finishing processes in Vietnam are subject to the order because unfinished butt-weld pipe fittings are covered by the scope and Commerce determined that unfinished butt-weld pipe fittings are not substantially transformed via finishing processes in Vietnam. 3. This preliminary covered merchandise determination is applicable on a country-wide basis, regardless of foreign producer, exporter, or importer. 4. Continue to suspend liquidation of entries of unfinished butt-weld pipe fittings that undergo finishing processes in Vietnam that are already subject to the suspension of liquidation in accordance with message 2271403, dated 09/28/2022. 5. For all entries of unfinished butt-weld pipe fittings that undergo finishing processes in Vietnam not already subject to the suspension of liquidation, CBP should suspend liquidation of: (i) shipments entered, or withdrawn from warehouse, for consumption on or after 09/26/2022, and (ii) shipments entered, or withdrawn from warehouse, for consumption prior to the date of initiation of the covered merchandise inquiry but no earlier than November 4, 2021. CBP shall require, for such entries, a cash deposit at the applicable rate(s) in effect on the date of entry. 6. Entries of products covered by paragraphs 4 and 5 should not be liquidated until specific liquidation instructions are issued. Any such entries that are set for liquidation must be unset immediately. 7. In accordance with 19 CFR 351.227(l)(5), this instruction does not affect or otherwise limit CBP's independent authority to take any additional action with respect to the suspension of liquidation or related measures. 8.
