1. On 03/26/2013 the U.S. Court of International Trade issued a Temporary Restraining Order (TRO) enjoining liquidation of certain entries of merchandise which were produced and/or exported from Taiwan by Nan Ya Plastics Corp., Ltd (Nan Ya); which were subject to the administrative determination published as Polyethylene Terephthalate Film, Sheet and Strip from Taiwan: Final Results of Antidumping Duty Administrative Review (case number A-583-837) (78 FR 9668; 02/11/2013); and which were entered, or withdrawn from warehouse, for consumption during the period 07/01/2010 through 06/30/2011.

2. This TRO was issued in connection with court case number 13-CV-00097 and enjoins liquidation of the entries described above. This TRO shall be effective for all entries which remain unliquidated as of 03/26/2013 and shall remain in effect until 5:00 p.m. on the fifth business day after Commerce's APO Docket Center was served with the preliminary injunction. Commerce's APO Docket Center was served with the above-referenced preliminary injunction on 03/27/2013.

3. This TRO applies to the liquidation instructions in message number 3058301, dated 2/27/2013.

4. Message number 3088301, dated 03/29/2013, addresses the preliminary injunction issued in this case.

5. Accordingly, effective 03/26/2013 and until 5 p.m. on 04/03/2013, CBP is instructed not to liquidate entries of merchandise subject to the TRO as described in paragraph 1. Any entries that are set for liquidation must be unset immediately. Continue to suspend liquidation of other entries of PET film from Taiwan that were produced and/or exported by Nan Ya and that were entered, or withdrawn from warehouse, for consumption during the period 07/01/2010 through 06/30/2011 until liquidation instructions are issued.
