1. On 02/15/2023, the U.S. Court of International Trade (CIT) issued a Injunction enjoining the United States, as well as its officers and agencies, from taking any action to enforce, implement, or execute Commerce's Final Results of the Antidumping Duty Administrative Review; 2020-2021, 87 Fed. Reg. 78639 (Dec. 22, 2022). The CIT further ordered that, for subject merchandise produced and/or exported by Oman Fasteners LLC, CBP is specifically enjoined from collecting estimated antidumping duty cash deposits on such merchandise equal to the 154.33 percent dumping margin applied to Oman Fasteners LLC by Commerce subsequent to the Final Results of the Antidumping Duty Administrative Review; 2020-2021, 87 Fed. Reg. 78639 (Dec. 22, 2022). This injunction was issued in connection with court number 22-00348. 2. As a result of this injunction, a cash deposit rate of 1.65 percent is applicable to entries of certain steel nails from the Sultanate of Oman that were produced and/or exported by Oman Fasteners LLC that were entered, or withdrawn from warehouse, for consumption, on or after 12/22/2022. 3. Because the revised cash deposit rate is to be applied retroactively, Commerce will issue instructions for granting a refund on any overcollection in a separate message. 4. These cash deposit instructions will remain in effect until further notice. 5. Do not liquidate entries of the merchandise covered by paragraph 2 until specific liquidation instructions are issued. On 01/27/2023, Commerce issued message 3027406, which enjoined liquidation of entries of certain steel nails from the Sultanate of Oman that were produced and/or exported by Oman Fasteners LLC that were subject of Commerce's final determination in Certain Steel Nails from the Sultanate of Oman: Final Results of the Antidumping Duty Administrative Review; 2020-2021, 87 Fed. Reg. 78639 (Dec. 22, 2022) that were entered, or withdrawn from warehouse, for consumption, during the period 07/01/2020 through 06/30/2021. 6.
