RE: CLARIFICATION OF SEAMLESS STAINLESS STEEL HOLLOW
PRODUCTS (A-401-603) WELDED STAINLESS STEEL HOLLOW
PRODUCTS (A-401-206) FROM SWEDEN

1. In the original investigation of stainless steel hollow products
(SSHP) from Sweden, the International Trade Commission (ITC)
determined there were two like products: seamless SSHP and welded
SSHP. The ITC found injury on imports of seamless SSHP but found no
injury on imports of welded SSHP. Therefore, the Department of
Commerce (DOC) issued an antidumping order only on seamless SSHP from
Sweden in December 1987. The investigation number for that order was
A-401-603.

2. Petitioner challenged the ITC's negative final determination
regarding welded SSHP. On November 27, 1990, the United States Court
of International Trade (CIT) affirmed the ITC's amended determination
upon remand that an industry in the United States is materially
injured by reason of imports of welded SSHP from Sweden. The DOC
then instructed the U.S. Customs Service to suspend liquidation of
all entries of welded SSHP at a zero percent deposit rate. The DOC
kept the same investigation number used for the original
investigation which was A-401-603.

3. Based on a request from U.S. Customs Service the DOC has assigned
separate investigation numbers for seamless SSHP and welded SSHP.
For reporting purposes, seamless SSHP from Sweden has been assigned
investigation number A-401-603 (the original investigation number for
the case) and welded SSHP from Sweden has been assigned the new
investigation number of A-401-206. These numbers should now be used
when dealing with the DOC.

/4. The products covered under the seamless SSHP investigation
(investigation number A-401-603) are seamless stainless steel
hollow products including pipes, tubes, hollow bars and blanks
therefor, of circular-cross section, containing over 11.5 percent
chromium by weight. Seamless SSHP products are currently
classifiable under HTS subheadings 7304.41.00 and 7304.49.00.
Effective December 3, 1987, a cash deposit of 20.47 percent applies
to all entries of seamless SSHP from Sweden that are entered or
withdrawn from warehouse, for consumption.

5. The products covered under the welded SSHP investigation
(investigation number A-401-206) are welded stainless steel hollow
products including pipes, tubes, hollow bars and blanks therefor,
of circular cross-section, containing over 11.5 percent chromium by
weight. Welded SSHP products are currently classifiable under HTS
subheadings 7306.40.10 and 7306.40.50. U.S. Customs Service shall
continue to suspend liquidation of all entries of welded SSHP from
Sweden that are entered or withdrawn from warehouse, for
consumption on or after December 7, 1990, at a zero percent deposit
rate.

6. The AD/CVD Module is being updated to reflect the updated
investigation numbers for seamless SSHP and welded SSHP.
