1. Commerce received a scope ruling request from Wheel Source, Inc. (Wheel Source). Commerce issued a final scope determination on 12/20/2019 that Wheel Source's passenger vehicle steel wheels which Wheel Source imports are not within the scope of the countervailing duty order on certain steel wheels 12 to 16.5 inches in diameter from the People's Republic of China (China) (C-570-091).

2a. Commerce determined that certain of Wheel Source's passenger vehicle wheels with a nominal wheel diameter of more than 16.5 inches are outside the scope of the order based on the plain language of the scope, which covers steel wheels with a nominal wheel diameter of 12 to 16.5 inches. These model numbers include: X-41757; X-41764; X-42755; X-44753; X-44754; X-44759; X-66021; X-66023; X-66024; X-66031B; X-41752; X-42751; X-42758; X-42768; X-43758; X-43765; X-50708; X-66027; X-66273A / X-43753; X-42855; X-41853; X-66034A.

2b. Commerce also determined that certain of Wheel Source's passenger vehicle wheels are outside the scope of the order because they have (1) different disc profiles to accommodate vehicle disc brakes and calipers and (2) lower load ratings that make them unsuitable for use on trailers or towable equipment. Therefore, Wheel Source's passenger vehicle steel wheels are not within the scope of the countervailing duty order on certain steel wheels 12 to 16.5 inches in diameter from China. These model numbers include:

3. For all entries of certain steel wheels 12 to 16.5 inches in diameter not within scope that remain unliquidated on or after 02/25/2019, CBP shall terminate suspension and liquidate entries of product not within scope which were entered, or withdrawn from warehouse, for consumption.

4. Refund any cash deposits relating to Wheel Source's passenger vehicle steel wheels described above.

5. These instructions constitute notice of the lifting of suspension of liquidation of entries of Wheel Source's passenger vehicle steel wheels entered, or withdrawn from warehouse, for consumption on or after 02/25/2019.

6. The assessment of countervailing duties by CBP on shipments or entries of this merchandise is subject to the provisions of section 778 of the Tariff Act of 1930, as amended. Section 778 requires that CBP pay interest on overpayments or assess interest on underpayments of the required amounts deposited as estimated countervailing duties. The interest provisions are not applicable to cash or bonds posted as estimated countervailing duties before the date of publication of the countervailing duty order. Interest shall be calculated from the date payment of estimated countervailing duties is required through the date of liquidation. The rate at which such interest is payable is the rate in effect under section 6621 of the Internal Revenue Code of 1954 for such period.

7. Unless instructed otherwise, for all other shipments of certain steel wheels 12 to 16.5 inches in diameter from China not covered by paragraph 2 above, you shall continue to collect cash deposits of estimated countervailing duties for the merchandise at the current rates.
