RE: The tariff classification of automotive brackets

Dear Mr. Forhart:

In your letter dated December 14, 2004 you requested a tariff classification ruling on behalf of Freightliner LLC.

Part number A07-19172-000 is a support bracket (RR TRA SUPT BRKT HD) made of steel. This bracket assists in mounting and supporting the weight of the transmission in a heavy-truck application.

Part number 16-15070-001 is a v-rod bracket (BRKT-V ROD,FRM MTD,841MM, FLX) made of cast iron-ductile iron. This v-rod bracket bolts to the inside of the truck’s frame rails, between the two rear tandem axles. This bracket mounts two pairs of axle control v-rods that go from the top of the axle carrier “hump” to the truck’s frame rails and provide lateral support.

Part number 18-28530-002 is a bulkhead bracket (BRKT-BULKHEAD TO XTUBE, 48/70RR) made of aluminum. This bulkhead bracket mounts together two cross tubes that combine to support the upper console, above the driver’s head, in a raised roof vehicle.

Part number 01-26318-001 is an engine mount bracket (BRKT RH RR ENG 3126) made of cast iron- ductile iron. This bracket bolts to the flywheel housing of the engine and supports the engine via attaching it to a corresponding mount that is bolted to the frame.

The applicable subheading for the A07-19172-000, 16-15070-001, 18-28530-002, and 01-26318-001 brackets will be 8302.30.3060, Harmonized Tariff Schedule of the United States (HTS), which provides for Base metal mountings, fittings and similar articles…Other mountings, fittings and similar articles suitable for motor vehicles; and parts thereof: Of iron or steel, of aluminum or of zinc, Other.

Your inquiry does not provide enough information for us to give a classification ruling on the auxiliary transmission bracket, part number 31104-3413. Your request for a classification ruling should include the name of the base metal comprising the item. When this information is available, you may wish to consider resubmission of your request. We are returning any related samples, exhibits, etc. If you decide to resubmit your request, please include all of the material that we have returned to you.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
