RE: The tariff classification of lab coats and blouses from Honduras.
Dear Mr. Stephens:
In your letter dated July 12, 2001 you requested a classification ruling.
The submitted samples are men’s and women’s lab coats and blouses. Style 3155 is a ladies labcoat composed of woven 65% polyester/35% cotton fabric. The garment is knee length with long sleeves open pointed collar, two patch pockets below the waist, left breast pocket and a full front button closure that closes right over left. Style 3140 is a men’s labcoat composed of woven 100% cotton fabric. The below the knee, long sleeve garment has an open pointed collar, two patch pockets below the waist, left breast pocket and a full front button closure that closes left over right. Style 7535 which you describe as a warm up jacket is a ladies long sleeve blouse/shirt composed of woven 65% polyester/35% fabric. The garment has no collar, two pockets and a full front button closure that closes right over left. Style 7525 is the same as Style 7535 with the exception of a snap closure from the neck down the front.
The applicable subheading for the ladies labcoat, style 3155 will be 6211.43.0091, Harmonized Tariff Schedule of the United States (HTS), which provides for “track suits…Other garments, women’s or girls’: Of man-made fibers, Other.” The duty rate will be 16.3% ad valorem. The textile category designation is 659.
The applicable subheading for the men’s labcoat, style 3140 will be 6211.32.0081, Harmonized Tariff Schedule of the United States (HTS), which provides for “Track suits…Other garments: Other garments, men’s or boys’: Of cotton, Other.” The duty rate will be 8.25 ad valorem. The textile category designation is 359.
The applicable subheading for the women’s jackets, styles 7535 and 7525 will be 6211.43.0060, Harmonized Tariff Schedule of the United States (HTS), which provides for “track suits…Other garments, women’s or girls’: Of man-made fibers, Blouses, shirts and shirts-blouses…excluded from heading 6206.” The duty rate will be 16.3% ad valorem. The textile category designation is 641.
Based upon international textile trade agreements products of Honduras are not subject to quota and the requirement of a visa.
The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
