RE: The tariff classification of women’s woven jacket-like garments from Hong Kong

Dear Mr. Allen:

In your letter dated March 26, 2001, you requested a classification ruling. The samples that you have submitted will be returned to you under separate cover.

Two women’s garments, styles 3SW37641 and 3SW3780, were submitted with your request. Both garments are made from 96 percent wool and 4 percent spandex woven fabric. Both garments will be marketed with coordinating pieces, trousers and skirts, in identical fabric.

Style 3SW37641 is a women’s tailored jacket-like garment that extends from the shoulders to approximately the knees. It is constructed with four vertical panels in the back and multiple vertical panels in the front. The jacket is fully lined and features a pointed collar, a full front opening secured by four buttons, long sleeves without cuffs and two vertical pockets located below the waist that are secured by zippers. The garment has a center back vent and a simulated belt trim on the rear.

Style 3SW3780 is a women’s tailored jacket-like garment that extends from the shoulders to approximately mid-calf. The garment is constructed with four vertical panels in both the front and the back and incorporates a self-fabric tie belt. It is fully lined and features a full front opening with a three button hidden placket, notched lapels, long sleeves without cuffs, a center back vent and pockets below the waist.

The applicable subheading for styles 3SW37641 and 3SW3780 will be 6211.41.0055, Harmonized tariff Schedule of the United States (HTS), which provides for other garments, women’s or girls’ jackets and jacket-type garments excluded from heading 6202, of wool. The duty rate will be 13.5 percent ad valorem. Styles 3SW37641 and 3SW3780 fall within textile category designation 435. Based upon international textile trade agreements products of Hong Kong are subject to quota restraints and a visa requirement.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.USTREAS.GOV. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
