RE: The tariff classification of a powered screwdriver from China

Dear Mr. Levine:

In your letter dated February 14, 2001 you requested a tariff classification ruling.

The Powered Screwdriver fits in the hand, weighs 10 ounces and measures approximately 5.75 inches. The cordless unit features a built-in electric motor powered by batteries. As indicated in your letter, the powered screwdriver will be principally used to drive screws of various lengths and sizes into wood, drywall, appliances and electrical devices.

The applicable subheading for the powered screwdriver together with its batteries will be 8508.80.0040, Harmonized Tariff Schedule of the United States (HTS), which provides for electromechanical tools for working in the hand with self-contained electric motor; parts thereof: Other tools…Screwdrivers, nut-runners and impact wrenches. The rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
