RE: The tariff classification of a ceramic wall plaque from China.
Dear Ms. Davenport:
In your letter dated February 8, 2001, you requested a tariff classification ruling. Sample is being returned as requested.
The sample submitted is a 5 ¼-inch square-shaped wall plaque that features a wooden frame with a 4 ¼-inch square-shaped insert of ceramic (porcelain) tile. There is depicted on the ceramic tile the design of three birdhouses surrounded by a foliage-like motif. This article also possesses a small metal loop, which is affixed to its upper posterior, for hanging purposes. The essential character of this composite article is imparted by the ceramic tile.
The applicable subheading for this decorative ceramic wall plaque will be 6913.10.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for other ornamental ceramic articles of porcelain or china, other. The rate of duty will be free.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
