RE: The tariff classification of a plastic pizza cutter and a plastic refrigerator magnet from Hong Kong.
Dear Ms. Ortega:
In your letter dated July 15, 1997, you requested a tariff classification ruling.
You have submitted two samples. Sample no. 1, is a plastic pizza cutter with a plastic blade. Sample no. 2, is a plastic refrigerator magnet. The circular refrigerator magnet memo holder is flat with a magnetic backing. Both samples have been inscribed with the "CVS" pharmacy logo. Your letter of inquiry states that these items will be given to customers at various locations.
The applicable subheading for the plastic pizza cutter will be 3924.10.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for tableware, kitchenware, other household articles...of plastics: tableware and kitchenware. The rate of duty will be 3.4 percent ad valorem.
The applicable subheading for the plastic refrigerator magnet will be 8505.19.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for electromagnets; permanent magnets and articles intended to become permanent magnets after magnetization;...other. The rate of duty will be 4.9 percent ad valorem.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
