RE: The tariff classification of mufflers for engines of unspecified origin

Dear Ms. Strom:

In your letter dated November 15, 2004 you requested a tariff classification ruling on behalf of American Honda Motor Company.

The articles in question are described as mufflers for general-purpose internal combustion engines. You indicate that the engines on which the mufflers are used have multiple applications, which can include use in edgers, pumps, lawn mowers and other agricultural equipment. The function of the mufflers is to silence or reduce the level of noise generated when an engine is running. Descriptive information was submitted.

The applicable subheading for the mufflers will be 8485.90.0080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other machinery parts, not containing electrical connectors, insulators, coils, contacts or other electrical features, and not specified or included elsewhere in this chapter. The general rate of duty will be 3.9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
