RE: The tariff classification of Plerixafor Injection and Chlorpromazine Hydrochloride Injection in dosage form, from India and France, respectively
Dear Mr. Shah:
In your letter dated January 31, 2023, you requested a tariff classification ruling.
Plerixafor Injection, imported in 24 mg/1.2 mL (20 mg/mL), is in a class of medications called hematopoietic stem cell mobilizers. It is indicated in combination with granulocyte-colony stimulating factor (GCSF) to mobilize hematopoietic stem cells (HSCs) to the peripheral blood for collection and subsequent autologous transplantation in patients with non-Hodgkin’s lymphoma (NHL) or multiple myeloma (MM).
Chlorpromazine Hydrochloride Injection USP, imported in 25 mg/mL, is an anti-psychotic drug. It is indicated for the treatment of schizophrenia; to control nausea and vomiting; for relief of restlessness and apprehension before surgery; for acute intermittent porphyria; as an adjunct in the treatment of tetanus; to control the manifestations of the manic type of manic-depressive illness; for relief of intractable hiccups; for the treatment of severe behavioral problems in children (1 year to 12 years of age) marked by combativeness and/or explosive hyperexcitable behavior (out of proportion to immediate provocations), and in the short-term treatment of hyperactive children who show excessive motor activity with accompanying conduct disorders consisting of some or all of the following symptoms: impulsivity, difficulty sustaining attention, aggressivity, mood lability, and poor frustration tolerance. In your letter, you stated Chlorpromazine Hydrochloride Injection will be imported from India.
The applicable subheading for the Plerixafor Injection in dosage form will be 3004.90.9215, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Medicaments … consisting of mixed or unmixed products for therapeutic or prophylactic uses, put up in measured doses … or in forms or packings for retail sale: Other: Other: Other: Antineoplastic and immunosuppressive medicaments.” The rate of duty will be free.
The applicable subheading for the Chlorpromazine Hydrochloride Injection in dosage form will be 3004.90.9235, HTSUS, which provides for“ Medicaments … consisting of mixed or unmixed products for therapeutic or prophylactic uses, put up in measured doses … or in forms or packings for retail sale: Other: Other: Other: Medicaments primarily affecting the central nervous system: Antidepressants, tranquilizers, and other psychotherapeutic agents.” The rate of duty will be free.
