RE: The tariff classification of Instant Herbal Tea Mix Powder from the United States
Dear Ms. Calloway:
This is in response to your submission on September 14, 2020, requesting a ruling on the classification of Instant Herbal Tea Mix Powder exported from the United States.
Pursuant to 19 C.F.R. Part 177, U.S. Customs and Border Protection (CBP) issues rulings concerning, among other things, the tariff classification of imported articles. Since this transaction involves an export from the United States, this office will issue an "information letter" pursuant to the authority of 19 C.F.R. 177.1(d) (2). It is expressly noted that information letters are intended to assist importers in their Customs transactions, but do not have the binding effect of a ruling letter.
The subject merchandise is described as Instant Herbal Tea Mix Powder in three different flavors: NRG Tea, NRG Tea-Green Apple Flavor and Green Tea-Pomegranate Flavor. Each flavor is packaged in a plastic bottle with a net weight of 60 grams (NRG Tea, NRG Tea-Green Apple Flavor) or 48 grams (Green Tea-Pomegranate Flavor). The products will be used to make beverages by adding water to them.
NRG Tea (Formula #F4463) is said to contain Maltodextrin, Green Tea Extract, Natural Lemon Flavor, Orange Pekoe Extract, Guarana Seed Extract, and Anhydrous Citric Acid.
NRG Tea-Green Apple Flavor (Formula #F4462) is said to contain Maltodextrin, Green Tea Extract,
Green Apple Flavor, Orange Pekoe Extract, Guarana Seed Extract, and Anhydrous Citric Acid.
Green Tea-Pomegranate Flavor (Formula# F4465) is said to contain Maltodextrin, Green Tea Extract and Pomegranate Flavor.
The applicable subheading for NRG Tea, NRG Tea-Green Apple Flavor and Green Tea-Pomegranate Flavor will be 2101.20 Harmonized Tariff Schedule of the United States (HTSUS), which provides for Extracts, essences and concentrates of coffee, tea or mate and preparations with a basis of these products or with a basis of coffee, tea or mate; roasted chicory and other roasted coffee substitutes, and extracts, essences and concentrates thereof: Extracts, essences and concentrates, of tea or mate, and preparations with a basis of these extracts, essences or concentrates or with a basis of tea or mate.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
