RE: The tariff classification of a fiber optic distribution box from China.

Dear Mr. Stenger:

In your letter dated March 23, 2018, you requested a tariff classification ruling on a fiber optic distribution box on behalf of Sonic Net.

The item is identified as part number TY-15132B. The box measures 150 millimeters by 120 millimeters by 37 millimeters. It is constructed from a polycarbonate (PC) and acrylonitrile butadiene styrene (ABS) plastic material. This article is used as a termination point for the feeder cable to connect with the drop cable in a “Fiber To The X” (FTTX) communication network system. One of these applications is “Fiber To The Home” (FTTH), where this plastic box would house the connection for a residential fiber optic telecommunication subscriber loop. It is suitable for both outdoor and indoor use. The box also features a locking mechanism to prevent tampering and theft.

As this fiber optic distribution box is considered an article of plastic and is not more specifically provided for elsewhere, the applicable subheading for part number TY-15132B will be 3926.90.9996, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “[o]ther articles of plastics and articles of other materials of headings 3901 to 3914: [o]ther: [o]ther: [o]ther.” The column one, general rate of duty is 5.3 percent ad valorem.
