RE: The tariff classification of Ribociclib Succinate (CAS No.1374639-75-4)) in bulk powder form, from Taiwan
Dear Ms. Liang:
In your letter dated September 25, 2017, you requested a tariff classification ruling.
Ribociclib Succinate is a kinase inhibitor used in combination with an aromatase inhibitor as initial endocrine-based therapy for the treatment of postmenopausal women with hormone receptor (HR)-positive, human epidermal growth factor receptor 2 (HER2)-negative advanced or metastatic breast cancer.
The applicable subheading for the Ribociclib Succinate in bulk form will be 2933.59.5300, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Heterocyclic compounds with nitrogen hetero-atom(s) only: Compounds containing a pyrimidine ring (whether or not hydrogenated) or piperazine ring in the structure: Other: Drugs: Aromatic or modified aromatic: Other.” The rate of duty will be 6.5 percent ad valorem. Currently, Ribociclib Succinate is not listed in the Pharmaceutical Appendix to the Tariff Schedule.
