RE: The tariff classification of a confectionary anti-sticking agent from Germany
Dear Mr. Wilk:
In your letter dated August 11, 2016, you requested a tariff classification ruling on behalf of your client, CAPOL LLC, IL.
An ingredients breakdown and product specification sheet accompanied your inquiry. Capol® 5108 is said to be a yellowish oily dispersion of typical odor and is said to be composed of vegetable oil, and carnauba wax. The product is said to function as an anti-sticking agent used for starch moulded confectionery, and gummies production. The product is packaged in 10 kg., 50 kg., or 100 kg., net weight, plastic airtight containers made of a high density polyethylene.
The applicable subheading for Capol® 5108 will be 2106.90.9998, Harmonized Tariff Schedule of the United States (HTSUS), which provides for food preparations not elsewhere specified or included…other…other…other. The general rate of duty will be 6.4 percent ad valorem.
