RE: The tariff classification of a reusable shopping bag from China

Dear Mr. Maldonado:

In your letter dated August 1, 2016, you requested a tariff classification ruling. You have submitted a sample, which is being returned to you under separate cover.

Item #102510210828, a reusable shopping-style tote bag, is constructed with an outer surface of non-woven polypropylene textile material. This construction is considered to be man-made textile for tariff purposes. The bag is designed to provide storage, protection, portability, and organization to groceries or other personal effects during travel. The bag features an open top without a closure, two carrying handles, and an unlined interior. It measures approximately 15 ½” (h) x 13” (w) x 6 ½” (d). The bag is of durable construction and suitable for repetitive use. The applicable subheading for the reusable shopping bag will be 4202.92.3131, Harmonized Tariff Schedule of the United States (HTSUS), which provides for travel, sports, and similar bags, with outer surface of textile material, other, other, of man-made fibers. The rate of duty will be 17.6 percent ad valorem.
