RE: The tariff classification of Nitrous Oxide (CAS # 10024-97-2) from Mexico
Dear Mr. Carberry:
In your letter received March 14, 2016, you requested a tariff classification ruling on Nitrous Oxide (CAS # 10024-97-2). You have stated that Nitrous Oxide (CAS # 10024-97-2) is intended to be used in the medical and electronics market. You submission indicates that the product at issue is a gas compound, which contains 100% Nitrous Oxide.
The applicable subheading for Nitrous Oxide (CAS # 10024-97-2) will be 2811.29.5000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Other inorganic acids and other inorganic oxygen compounds of nonmetals: Other inorganic oxygen compounds of nonmetals: Other: Other. The general rate of duty will be 3.7 percent ad valorem.
This merchandise may be subject to the requirements of the Toxic Substances Control Act (TSCA), which are administered by the U.S. Environmental Protection Agency.
