RE: The tariff classification of plastic lidded food containers from China
Dear Ms. Kong:
In your letter dated February 1, 2016, you requested a tariff classification ruling.
The two submitted samples are identified as plastic containers with lids. Each of the containers is cylindrical in shape and is made of clear polypropylene (PP) plastic material. One sample has an 8 ounce volume capacity and measures approximately 111/16” in height. The other sample has a 12 ounce volume capacity and measures approximately 25/16” in height. Each container measures approximately 4½” in diameter at the top and 3¼” in diameter at the bottom. The small container is slightly broader just above the bottom than the larger container. These containers are designed to be used for multi-purpose storage of food snacks, leftovers, sauces, etc.
The applicable subheading for the plastic containers with lids will be 3924.10.4000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for for tableware, kitchenware …of plastics: tableware and kitchenware: other. The rate of duty will be 3.4 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
