RE: The tariff classification of “CHE-COAT-DF 681F” from Germany
Dear Ms. Bowman:
In your letter received January 11, 2016, you requested a tariff classification ruling on “CHE-COAT-DF 681F.” You have indicated that the product at issue is intended to be used as an anti-foaming agent in the manufacture of automotive coatings and paints. You have described “CHE-COAT-DF 681F” as a petroleum oil-based mixture in liquid form.
The applicable subheading for “CHE-COAT-DF 681F” will be 3402.90.5050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Organic surface-active agents (other than soap); surface-active preparations, washing preparations (including auxiliary washing preparation) and cleaning preparations, whether or not containing soap, other than those of heading 3401: Other: Other: Other: Other. The general rate of duty will be 3.7 percent ad valorem.
This merchandise may be subject to the requirements of the Toxic Substances Control Act (TSCA), which are administered by the U.S. Environmental Protection Agency.
