RE: The tariff classification of a fan assembly from China.

Dear Mr. Anderson:

In your letter dated November 12, 2015, on behalf of International Buying Group, LTD., you requested a tariff classification ruling. Descriptive literature and technical drawings were included with your submission.

The product under consideration is a condenser fan assembly, model number ODM-016F-6A. The condenser fan assembly is also referred to as a “fan assembly” and is designed for use in domestic refrigerators. The fan assembly’s function is to move ambient air across the condenser coil and consists of a plastic fan blade and a DC motor operating on 12 volts. The motor includes a wire lead assembly with a low voltage connector. It is stated that upon importation, the fan assembly is attached to a plastic frame, which is then mounted to the refrigerator cabinet.

Heading 8414, Harmonized Tariff Schedule of the United States (HTSUS), provides for fans that are designed either for delivering large volumes of air or other gases at relatively low pressure or merely for creating a movement of surrounding air. Fans classified in HTSUS heading 8414 may or may not be fitted with integral motors. Thus, based on the information provided, we find that the subject fan assembly is a fan classified under heading 8414, HTSUS, and the applicable subheading for the condenser fan assembly, model number ODM-016F-6A, will be 8414.59.6090, HTSUS, which provides for axial fans. The general duty rate is 2.3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
