RE: The tariff classification of Halloween “Zombie-Arm” pathway markers from China

Dear Ms. Liao:

In your letter dated October 27, 2015, you requested a tariff classification ruling.

The item in question is a set of Halloween “Zombie-Arm” pathway markers (Item # 630315774). The set consists of three plastic zombie-arms each holding a lantern. This electronic device incorporates a sound module, a sound sensor and lights within each lantern. The pathway markers are powered by three AA batteries which are included. The Halloween “Zombie-Arm” pathway markers provide Halloween style lighting and sound effects.

The applicable subheading for the Halloween “Zombie-Arm” pathway markers (Item # 630315774) will be 8543.70.9650, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Electrical machines and apparatus, having individual functions, not specified or included elsewhere…: Other machines and apparatus: Other: Other: Other: Other.” The rate of duty will be 2.6%.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
