RE: The tariff classification of a mixer/kneader from France

Dear Mr. Hansel:

In your letter dated October 2, 2015 on behalf of Prodesa North America Corp. you requested a tariff classification ruling.

The stationary mixer/kneader is designed to work with a variety of agricultural-origin materials such as wood flour. Water is added to the material in the mixing/kneading chamber. Moving blades are utilized to mix the material to the desired consistency. This process results in a mixture that will be subsequently pelletized on a separate machine. The unit’s motor may be shipped assembled to the machine or not.

The applicable subheading for the mixer/kneader will be 8479.82.0040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Machines and mechanical appliances having individual functions, not specified or included elsewhere in this chapter; parts thereof: Other machines and mechanical appliances: Mixing, kneading, crushing, grinding, screening, sifting, homogenizing, emulsifying or stirring machines … Mixing, kneading or stirring machines”. The duty rate will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
