RE: The tariff classification of Coca Cola Ice Pack from China

Dear Mr. Hansel:

In your letter dated May 13, 2015, filed on behalf of Cool Gear International LLC, you requested a tariff classification ruling and provided a sample of this merchandise. This sample will be returned to you.

The product, Coca Cola Ice Pack, is a bottle cap shaped freeze pack containing a non-toxic freezer gel. The freeze pack is placed in the freezer until use. When transferred to a cooler or other container, it keeps food colder. The ice pack can then be returned to the freezer for cooling until the next use.

The applicable subheading for the Coca Cola Ice Pack will be 3824.90.9290, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Chemical products and preparations of the chemical or allied industries (including those consisting of mixtures of natural products), not elsewhere specified or included: Other: Other: Other: Other: Other: Other. The rate of duty will be 5 percent ad valorem. The rate of duty will be 5 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
