RE: The tariff classification of polyamides

Dear Ms. McLafferty:

In your letter dated June 17, 2014, on behalf of Aquafil USA, Inc., Georgia, you requested a tariff classification ruling.

Illustrations were provided for three products. The product identified as “PA6 Fiber Fluff” consists of 98.45% nylon 6 and 1.55% undefined ash and volatiles. The product identified as “PA6 Fiber Densified” consists of 99.02% nylon 6 and .98% undefined ash and volatiles. The product identified as “PA6 Fiber Pellets” consists of 98.25% nylon 6 and 1.75% undefined ash and volatiles.

You have not identified the country of origin. The rate of duty provided below is the rate applicable to the merchandise when it is manufactured in a country with which the United States has Normal Trade Relations.

The applicable subheading for the PA6 Fiber Pellets will be 3908.10.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for polyamides in primary forms: polyamide-6, -11, -12, -6,6, -6,9, -6,10 or -6,12. The general rate of duty will be 6.3% ad valorem.

Your inquiry does not provide enough information for us to give a classification ruling on the PA6 Fiber Fluff or the PA6 Fiber Densified. Your request for a classification ruling should include a small sample bag of each. Identify the country where the fibers are recovered. Provide complete details on how the fiber is recovered and then densified. When this information is available, you may wish to consider resubmission of your request. If you decide to resubmit your request, please include all of the material that we have returned to you.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
