RE: The tariff classification of Famotidine Tablets (CAS-76824-35-6), imported in dosage form, from India
Dear Mr. van de Beek:
In your letter dated February 20, 2014, you requested a tariff classification ruling.
The subject product, Famotidine Tablets, imported in 20 mg and 40 mg tablets, is a medicinal preparation containing, Famotidine, a histamine H2 receptor antagonist, as the active ingredient. It is indicated for the treatment of peptic ulcer disease and gastroesophageal reflux disease (GERD).
The applicable subheading for the Famotidine Tablets in dosage form will be 3004.90.9160, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Medicaments … consisting of mixed or unmixed products for therapeutic or prophylactic uses, put up in measured doses … or in forms or packings for retail sale: Other: Other: Other: Medicaments primarily affecting the digestive system: Other." The rate of duty will be free.
