RE: The tariff classification of pipe thread protectors from India and Moldova

Dear Mr. Trubits:

In your letter dated October 22, 2013, on behalf of Protective Industries, Inc. DBA Caplugs, you requested a tariff classification ruling.

Two samples identified as pipe thread protectors were provided with your letter. The thread protectors are designed to be attached to the ends of threaded pipes to provide protection for rig ready casing and tubing sections during short term transportation and storage. The “box” style thread protector screws into the ends of pipes with inner threads. The “pin” style thread protector screws over the ends of pipes with outer threads. The pipe thread protectors are composed of high density polyethylene plastic. They are available with a reinforcing steel ring or band for additional support. The sample pin protector contains the outer metal reinforcing band.

The applicable subheading for the plastic pipe protectors, with or without the additional steel reinforcement, will be 3926.90.9980, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other articles of plastics, other. The general rate of duty will be 5.3 percent ad valorem.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

Articles classifiable under subheading 3926.90.9980, HTSUS, which are products of India or Moldova may be entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. The GSP is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse. To obtain current information on GSP, check our Web site at www.cbp.gov and search for the term “GSP”.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
