RE: The tariff classification of clamp bands from China.
Dear Mr. Manlapaz:
In your letter dated October 17, 2013 you requested a tariff classification ruling.
The products you plan to import are described as clamp bands, part numbers 04-7100-08S,
08-7300-08S and 15-7100-08S. These steel bands are used to hold the liquid chambers onto the air chambers in an air operated diaphragm pump.
You have proposed classification for the subject clamp bands under subheading 7326.90.8588, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other articles of iron or steel…other, other. You stated in your letter that Explanatory Note Part 1 for heading 7326 provides for articles of iron or steel and that clamping or tightening are specifically provided for under this chapter. Please note that the first paragraph for the ENs to heading 7326 states that “This heading covers all iron and steel articles…other than articles…more specifically covered elsewhere in the Nomenclature”. Heading 7326 covers a wide range of iron or steel articles that are not more specifically provided for elsewhere in the HTSUS. However, the clamp bands under consideration are not classifiable in heading 7326, HTSUS, because they are provided for more specifically in another heading of the HTSUS.
The applicable subheading for the clamp bands will be 8413.91.9080, HTSUS, which provides for pumps for liquids, whether or not fitted with a measuring device; liquid elevators; parts thereof, parts, of pumps, other, other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
