RE: The tariff classification of a nonwoven geotextile fabric
Dear Mr. Pike:
In your letter dated August 2, 2013, on behalf of your client Lumite, you requested a tariff classification ruling.
A representative sample was submitted with your ruling request. U.S. Customs & Border Protection (CBP) lab analysis indicates the sample is a needleloom felt made wholly of man-made staple fibers. It was constructed by a needle-punching method and has no additional bonding. Your letter indicates this material will be imported as roll goods.
The applicable subheading for the non-woven polypropylene geotextile fabric will be 5602.10.9090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Felt, whether or not impregnated, coated, covered or laminated: Needleloom felt and stitch-bonded fiber fabrics: Other Other. The rate of duty will be 10.6 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
