RE: The tariff classification of apple pulp from Chile

Dear Mr. Skinner:

In your letter dated July 15, 2013, you requested a tariff classification ruling on behalf of Materne North America Corporation, NY.

A technical specification sheet accompanied your inquiry. Additional information was provided via email transmissions dated July 22 and July 23, 2013. The merchandise is described as single strength apple puree, with trace amounts of ascorbic acid and citric acid. The product is produced from fresh mature apples that have been washed, peeled, stoned, ground, homogenized, heated at 20 to 88 degrees Centigrade for three minutes to inactivate enzymes, de-aerated, homogenized, filtered, refined, homogenized, filtered, de-aerated, filtered, pasteurized, cooled and packed in aseptic bags in drums, weighing 220 kilograms to 1000 kilograms.

The applicable subheading for the apple pulp will be 2008.99.0500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for fruit … otherwise prepared or preserved, whether or not containing added sugar or other sweetening matter or spirit, not elsewhere specified or included … other, including mixtures … other … apples. The rate of duty will be 0.9 cents per kilogram.
