RE: The tariff classification of woven house wrap material, from India.

Dear Ms. Ekman:

In your letter dated June 3, 2013, on behalf of Harmony Plastics PVT, Ltd. India, you requested a tariff classification ruling.

The instant sample, according to your correspondence, consists of a woven fabric composed of polypropylene plastic strips which measure 2.41 mm in width in one direction and 1.48 mm in the other. Plastic strips measuring less than 5 mm in apparent width are considered to be of textile material for tariff purposes. Woven in to this material at approximately 1¼" intervals are plastic filaments that measure .4826 mm in diameter and as such, are considered to be of man-made fibers for tariff purposes. This material has been coated on one side with a clear polypropylene plastics material in sufficient quantity to be visible to the naked eye. The following weight breakdown was provided:

Wt. of textile fabric: 52 g/m² (71.2%) Wt. of PP coating: 21 g/m² (28.8%) Total Wt.: 73 g/m²

The applicable subheading for the material, which we presume will be imported as roll goods, will be 5903.90.3090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for textile fabrics impregnated, coated, covered or laminated with plastics, other than of polyvinyl chloride or polyurethane, … of other than man-made fibers. The duty rate will be 2.7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
