RE: The tariff classification of security monitors from China and Korea

Dear Mr. Villiard:

In your letter dated May 27, 2013, on behalf of Samsung OPTO Electronics America, Inc., you requested a tariff classification ruling.

The merchandise under consideration is security monitors, which are used as the visual component of a security system, models SMT-1930, SMT-1934, and SMT-2232, with diagonal-screen sizes measuring approximately 18.5 inches, 19 inches, and 21.5 inches, respectively. These monitors consist of flat-panel LCD screens with LED backlights and contain analog RGB connectors as well as VGA and HDMI connectors. They do not contain a television tuner or any video recording or reproducing capability, but they are capable of displaying signals or data from an ADP machine in a form that meets the requirements of the user.

In your request, you suggested classification in subheading 8528.59.2100, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Monitors and projectors, not incorporating television reception apparatus… Other monitors: Other: Color: With a flat panel screen: Incorporating video recording or reproducing apparatus: Other: Flat panel display devices designed for use with an automatic data processing machine, as defined in additional U.S. note 13 to chapter 85. However, the monitors in question do not contain any video recording or reproducing apparatus; therefore, this subheading is not applicable.

The applicable subheading for these security monitors will be 8528.59.3100, HTSUS, which provides for Monitors and projectors, not incorporating television reception apparatus…Other monitors: Other: Color: With a flat panel screen: Other: Other: Flat panel display devices designed for use with an automatic data processing machine, as defined in additional U.S. note 13 to chapter 85. The rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
